TERMS & CONDITIONS

These Terms & Conditions apply to all orders placed through the online shop of STUDIO BERG.

 

1. SCOPE

These Terms & Conditions apply to all purchases made through www.studioberg.de between STUDIO BERG and its customers.

A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession. A business customer is any natural or legal person or partnership acting in the course of its commercial or independent professional activity.

3. PRODUCTS AND HANDCRAFTED CHARACTER

STUDIO BERG develops and produces design objects in small series, often in collaboration with specialised craftspeople and manufacturers in Europe.

Many of our objects are handmade and involve several manual production processes. Small variations in colour, shape, surface, dimensions, material distribution, contours and other details are therefore inherent to the production process and make each object individual.

Product photographs and descriptions are intended to represent our products as accurately as possible. However, individual handmade pieces may vary slightly from the photographs shown on the website. Screen settings may also affect the appearance of colours.

Minor variations resulting from the handmade production process do not constitute a defect, provided that they do not materially impair the agreed characteristics or intended use of the product. Statutory rights concerning defective goods remain unaffected.

 

4. ORDERS AND CONCLUSION OF CONTRACT

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.

By submitting an order through the checkout, you make a binding offer to purchase the products in your shopping cart.

After placing your order, you will receive an automated order confirmation by email. Unless expressly stated otherwise in that confirmation, the purchase contract is concluded when we accept your order or dispatch the goods.

We reserve the right not to accept an order, for example if a product is unavailable, an obvious pricing or product information error has occurred, or payment cannot be processed. Any payment already received for an order that we cannot accept will be refunded.

 

5. PRICES AND PAYMENT

All prices displayed in the online shop are stated in euros and include German VAT where applicable, unless expressly indicated otherwise.

Shipping costs are shown separately during the checkout process.

For deliveries outside the European Union, additional customs duties, import taxes or other charges may apply. These charges are not collected by STUDIO BERG and are the responsibility of the recipient in accordance with the regulations of the destination country.

The payment methods currently available are displayed during checkout.

 

6. AVAILABILITY AND PRODUCTION TIMES

Many STUDIO BERG objects are produced in small batches and some are made after an order has been placed.

Production and delivery times stated on the website are estimates unless expressly agreed as binding. As our objects may involve several manual production stages and independent craft workshops, production times can occasionally vary.

If a significant delay occurs after an order has been placed, we will inform you as soon as reasonably possible.

 

7. DELIVERY

We deliver to the countries available for selection during checkout.

Shipping costs and available shipping options are displayed during the ordering process.

Customers are responsible for providing a complete and correct delivery address. Additional costs caused by an incorrect or incomplete address or by an unjustified failure to accept delivery may be charged to the customer where legally permissible.

For deliveries outside the European Union, customs procedures may cause additional delays beyond our control.

 

8. TRANSPORT DAMAGE

Please inspect your order upon delivery.

If a parcel or product arrives visibly damaged, please contact us as soon as possible at hello (at) studioberg.de and, if possible, include photographs of the packaging and the damaged object. This helps us resolve the issue with you and, where applicable, with the shipping provider.

Failure by a consumer to report transport damage immediately does not affect their statutory rights.

 

9. RIGHT OF WITHDRAWAL

Consumers generally have the statutory right to withdraw from an online purchase within 14 days without giving a reason.

For the purchase of goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

To exercise the right of withdrawal, the consumer must inform STUDIO BERG of the decision to withdraw from the contract by means of a clear statement, for example by email.

10. RETURNS AND RETURN SHIPPING

Following a valid withdrawal, the goods must be returned without undue delay and no later than 14 days from the day on which the consumer informed us of the withdrawal.

The consumer bears the direct cost of returning the goods.

Please pack returned objects carefully and securely. Where possible, we recommend using the original protective packaging, particularly for fragile glass and ceramic objects.

The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

These provisions do not affect statutory rights relating to defective or incorrectly supplied goods.

 

11. REFUNDS

In the event of a valid withdrawal, we will refund all payments received from the consumer in connection with the returned goods, including the cost of our least expensive standard delivery option.

Additional delivery costs resulting from the consumer choosing a more expensive delivery method, such as express delivery, are not refundable beyond the cost of our standard delivery option.

Refunds will be made without undue delay and no later than 14 days after we have been informed of the decision to withdraw.

We may withhold the refund until we have received the returned goods or until the consumer has provided evidence that the goods have been sent back, whichever occurs first.

Unless otherwise agreed, the refund will be made using the same payment method used for the original transaction.

 

12. CUSTOM-MADE AND PERSONALISED PRODUCTS

The statutory right of withdrawal does not apply to goods that are not prefabricated and are made on the basis of an individual choice or specification by the customer, or which are clearly personalised to the customer's individual requirements.

This may include, for example, individually commissioned sizes, colours, configurations or other specifications produced specifically for a customer.

A product is not excluded from the right of withdrawal merely because it is produced or finished after an order is placed. Standard products and standard variants offered as part of the regular STUDIO BERG collection remain subject to the statutory right of withdrawal where applicable.

Where a product is individually made to customer specifications and therefore excluded from the statutory right of withdrawal, this will be communicated to the customer before the order is placed.

 

13. RETENTION OF TITLE

Goods remain the property of STUDIO BERG until payment has been made in full.

 

14. WARRANTY

Statutory warranty rights apply.

Due to the handmade nature of many STUDIO BERG products, minor variations in colour, shape, dimensions, contours, surface, material distribution or other characteristics may occur as described in Section 3.

These characteristic variations are not defects where they fall within the reasonable characteristics of handmade production and do not materially impair the agreed quality or intended use of the object.

This does not limit statutory warranty rights in relation to actual defects.

 

15. LIABILITY

STUDIO BERG is liable without limitation for damage caused intentionally or through gross negligence and for injury to life, body or health.

In cases of slight negligence, STUDIO BERG is liable where an essential contractual obligation has been breached. In such cases, liability is limited to foreseeable damage typical for the contract, to the extent permitted by law.

Mandatory statutory liability, including liability under the German Product Liability Act, remains unaffected.

 

16. INTELLECTUAL PROPERTY

Unless otherwise stated, all content on this website, including photographs, texts, product designs, graphics, illustrations and other materials, is protected by intellectual property rights.

Content may not be reproduced, distributed, published, commercially used or otherwise exploited without prior permission from STUDIO BERG or the respective rights holder, except where permitted by law.

Purchasing a STUDIO BERG product does not transfer any intellectual property rights in the design of the product.

 

17. CONSUMER DISPUTE RESOLUTION

STUDIO BERG is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

18. APPLICABLE LAW

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable in the country of their habitual residence.

 

19. FINAL PROVISIONS

If individual provisions of these Terms & Conditions are or become invalid, the validity of the remaining provisions remains unaffected, insofar as permitted by law.

The statutory provisions apply in place of any invalid provision.
